This bail application has been filed under Section 439

Cr.P.C in connection with FIR No. 3/2021, registered at Police

Station Makbara, District Kota City, Kota for the offences under

Sections 3 and 25 of the Arms Act.

Learned counsel for the petitioner submits that the

complainant has lodged FIR for the offences under Sections 3 and

25 of the Arms Act. Charge-sheet has already been filed and

petitioner has criminal antecedents of seven other criminal cases

out of which he has been acquitted in five criminal cases. Counsel

further submits that the bail application of co-accused Inus @

Yunus Pathan has already been granted by the coordinate bench

of this court vide order dated 27.04.2021. Hence, the petitioner

may be released on bail.

Learned Public Prosecutor has opposed the bail

application and submitted that as per rejection bail order,

petitioner has criminal antecedents of seven other criminal cases.

Hence, the bail application of the petitioner may be rejected.

Considering the submissions made by learned counsel

for the petitioner and taking into consideration overall facts and

circumstances of the case but without expressing any opinion on

the merits/demerits of the case, this court deems it just and

proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439

Cr.P.C. is allowed and it is ordered that the accused-petitioner

Aman Quereshi @ Jassu son of Jahid Quereshi shall be enlarged

on bail provided he furnishes a personal bond in the sum of

Rs.50,000/- with two sureties of Rs.25,000/- each to the

satisfaction of the learned trial judge for his appearance before the

court concerned on all the dates of hearing and as and when

called upon to do so.
