This bail application has been filed under Section 439

Cr.P.C. in connection with FIR No. 345/2018 registered at Police

Station Udyog Nagar, District Sikar, for the offence under Sections

323,341,143, 325 and 307/34 of IPC.

Learned counsel for the petitioner submits that there is no

direct allegation against the petitioner. Petitioner is 25 years old

young boy. Charge-sheet has already been filed. Looking to the

police statement of injured Omprakash, the bail application may

kindly be granted.

Learned Public Prosecutor has opposed the bail application.

Heard and perused the material available on record.

As per injury, x-ray and medical reports of injured

Omprakash, he got three injuries which all are grevious in nature

and injury No.1 is endangerous to life. As per police statements

of Pooranmal, Sandeep, Surendra Kumar Nehra and Harish Kumar

Padihar, petitioner alongwith Sunil pelted stones, due to which

injured Omprakash got injury on his head and fell down.

Therefore,

taking into consideration overall facts and

circumstances of the case but without expressing any opinion on

the merits/demerits of the case, I deem it not proper to enlarge

the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

hereby dismissed.

However, the petitioner is at liberty to file afresh bail

application after recording the statement of injured Omprakash,

Medical Officer, Investigation officer, Pooranmal, Sandeep,

Surendra Kumar Nehra and Harish Kumar Padihar.
