This petition has been filed by the petitioner in public interest
raising an issue with regard to construction allegedly illegal by the
private respondents.
Referring to the reply filed, learned counsel appearing for the
respondent Nos. 4, 5 & 6 would submit that even before filing of
the writ petition, the Corporation had initiated proceedings against
the private respondents on receipt of such complaints and its
premises were sealed. Reply has been obtained from the private
respondents and the matter is pending consideration.
He would submit that the Corporation would be taking
appropriate decision in the matter and after consideration of reply
of the private respondents with regard to the complaints of illegal
construction.
In view of the aforesaid statement and the material available
on record, we are of the view that the purpose of filing of this PIL
has been served. The corporation shall take appropriate decision
in accordance with law.
Giving liberty to all the parties to take such remedy as may
be available to them under the law in the eventuality of filing
order being passed by the Corporation, we are disposed off this
PIL.
