The applicant is present in person.

An application (I.A. No.1408/2023) has been submitted for

condoning the delay in filing the restoration application.

For the reasons stated in the application, the same is

allowed.

The applicant has filed the present restoration application

under Order 41 Rule 19 read with Section 151 of the CPC for

restoration of S.B. Civil Transfer Application No.184/2021. This

had been dismissed vide order dated 31.03.2023, passed by

Registrar (Judicial) for non-compliance of peremptory order dated

09.03.2023.

Considering the averments made in the application, the

restoration application is allowed, and S.B. Civil Transfer

Application is to be restored to its original reference number.

Registry is directed to list the S.B. Civil Transfer Application

in the appropriate category.

Furthermore, the current application (I.A. No.1/2023) is filed

to seek permission for a change in counsel.

For the reasons stated in the application, the same is

granted.

List the matter on 31.10.2023.
