Present application has been filed under Section 439

Cr.P.C. for grant of regular bail to the petitioner in a case arising

out of F.I.R. No.277/2013, registered at Police Station,

Kishangarh, Ajmer, for offences punishable under Sections 420,

406, 465, 466, 467, 468, 471 and 120-B I.P.C.

The learned counsel appearing for the petitioner has

relied upon the order granting bail to co-accused, namely Chaman

Singh. Co-accused, Chaman Singh was released on bail, vide S.B.

Criminal Miscellaneous Bail Application No.12821/2013, on

19.12.2013.

Order granting bail to co-accused, Chaman Singh,

reads as under : -

“The present bail application has been filed under Section 439 Cr.P.C.

for grant of regular bail to the petitioner in a case arising out of FIR

No.277/2013 registered at Police Station Kishangarh Distt. Ajmer for

the offences under section 406, 420, 465, 466, 467, 468, 471, 120B of

IPC.

Shri Sher Singh Mahla, counsel for the complainant has submitted that

petitioner had fabricated the documents and by impersonation had sold

the property belonging to father-in-law of the complainant.

Petitioner was arrested on 25

th November, 2013. Period of police

remand is over and he is in judicial custody.

It is case of Magisterial trial and trial will take a long time to conclude.

Truth and veracity of the allegations shall be determined by the trial

court during the course of the trial hence, continuous detention of the

petitioner as an under trial is not warranted.

Consequently, the present petition is accepted and the petitioner is

ordered to be released on bail during the pendency of the trial to the

satisfaction of the trial court.”

For the reasons stated in the order granting bail to

co-accused, the present application is, hereby, accepted, on the

ground of parity and the petitioner is ordered to be released on

bail during the pendency of the trial, to the satisfaction of the

trial Court.
