Looking to the situation of Covid-19, defect Nos. 1 & 2

are overruled and learned counsel for the petitioner is directed to

remove the defect No.3 pointed by the Office in S.B. Criminal

Misc. Bail Application No.9326/2021.

Defect No.1 pointed by the Office is removed as in S.B.

Criminal Misc. Bail Application No.9326/2021 petition against the

petitioner No.1-Akhlesh has been withdrawn. Learned counsel for

the petitioner is directed to remove the defect No.2 pointed by the

Office in S.B. Criminal Misc. Bail Application No.9572/2021.

These bail applications have been filed under Section

439 Cr.P.C. in connection with same FIR No. 231/2021 registered

at Police Thana Sikri, District Bharatpur for the offences under

Sections 3, 5 and 8 of the Rajasthan Camel (Prohibition of

Slaughter and Regulation of Temporary Migration or Exported) Act,

2015.

Mr. Rahul Sinsinwar, learned counsel for the petitioners

submits that he may be permitted to withdraw the present bail

application of the petitioner No.1-Akhlesh (S.B. Criminal Misc. Bail

Application No.9326/2021), as the bail application on his behalf

has already been filed before this Court.

Ordered accordingly.

Learned counsel for both the petitioners submits that

the petitioners are in custody since long and they were not

exporting the Camels. Learned counsel for the petitioner-Akhlesh

submits that the petitioner is shepherd and he is owner of the

Camel. Counsel further submits that the petitioners have no

criminal antecedents. Hence, the accused-petitioners may be

released on bail.

Learned Public Prosecutor has strongly opposed the bail

application.

Heard learned counsel for the parties and perused the

material available on record.

Considering the submissions made by learned counsel

for the petitioners and taking into consideration overall facts and

circumstances of the case; but without expressing any opinion on

the merits/demerits of the case, this court deems it just and

proper to enlarge the petitioners on bail.

Consequently, these bail applications under Section 439

Cr.P.C. are allowed and it is ordered that the accused-petitioners

Aadil S/o Jakir and Akhlesh S/o Ramsingh shall be enlarged on bail

provided each of them furnishes a personal bond in the sum of

Rs.50,000/- with two sureties of Rs.25,000/- each (out of which

one surety shall be resident of Bharatpur District) to the

satisfaction of the learned trial Judge for their appearance before

the Court concerned on all the dates of hearing and as and when

called upon to do so.
