The present bail application has been filed under Section 439

Cr.P.C. The petitioner has been arrested in connection with FIR

No.45/2019 Registered at Police Station Masuda, District Ajmer for

the offence(s) under Sections 376D, 363, 366, 342 and 120B IPC

and Section 3/4 of Protection of Children from Sexual Offence Act.

Counsel for the petitioner submits that the prosecutrix in her

statement recorded under Section 164 Cr.P.C. stated that she went

with the petitioner at her own free will and petitioner has not

committed rape on her.
