This revision petition has been filed against the

impugned judgment & order dated 3.11.2009 passed

by learned Addl. Sessions Judge (FT) Hindaun city,

Distt. Karauli in cr. appeal no. 77/2008 whereby appeal

of the petitioner was dismissed confirming the order

dated 29.3.2007 passed by Addl. Chief Judl.

Magistrate, Hindaun city in cr. case no. 674/2005

whereby the petitioner was convicted and sentenced as

under:

U/s.356 IPC: 06 months SI and fine of Rs.250/-; in

default of payment of fine to further undergo

15 days SI.

U/s.379/511 IPC: 06 months SI and fine of Rs.500/-;

in default of payment of fine to further

undergo 15 days SI.

Briefly stated facts of the case are that an FIR

No.535/2005 for the offences under Sec.379 and 411

IPC was registered at P.S. Suroth Distt. Karauli. After

usual investigation, police filed charge-sheet before the
