This bail application has been filed under Section 439
Cr.P.C in connection with FIR No.184/2022 registered at Police
Station Shastri-Nagar, District Jaipur Metropolitan for the offences
under Sections 304, 342, 344, 370(5) & 374 of IPC, under
Sections 75 & 79 of of Juvenile Justice (Care and Protection) Act,
under Sections 3 & 14 of Child Labour (Prohibition and Regulation)
Act and under Sections 14, 16, 17 & 18 of The Bonded Labour
System (Abolition) Act.

Learned counsel for the petitioners submits that the
petitioners are behind the bars since 04.05.2022 and they have no
criminal antecedents. Charge-sheet has been filed. Counsel further
submits that looking to the facts and circumstances of the case,
the petitioners may kindly be released on bail.
Learned Public Prosecutor has opposed the bail
application.
Considering the submissions made by learned counsel
for the petitioners and taking into consideration overall facts and
circumstances of the case but without expressing any opinion on
the merits/demerits of the case, this court deems it just and
proper to enlarge the petitioners on bail.
Accordingly, the bail application under Section 439
Cr.P.C. is allowed and it is ordered that the petitioners Shekh
Sabir S/o Shri Mohmmad Hafeez and Emran S/o Shri
Maksood Alam shall be enlarged on bail provided each of them
furnishes a personal bond in the sum of Rs.50,000/- with two
sureties of Rs.25,000/- each (out of which one surety shall be the
resident of Jaipur Metro or Jaipur District) to the satisfaction of the
learned trial Judge for their appearance before the court
concerned on all the dates of hearing and as and when called upon
to do so.
