These bail applications under Section 439 Cr.P.C. have been

filed by petitioners in connection with FIR No.182/2022, registered

at Police Station Gandhi Nagar, District Jaipur City (East) wherein

they are charged for offences punishable under Sections 3/4 of the

Rajasthan Public Examination (Use of Unfair Means) Act, 1992,

Section 419 and 120 B of IPC.

Learned counsel for petitioners submits that the alleged

offences are triable by First Class Magistrate and the petitioners are

having no criminal antecedents. They are in judicial custody since

22.05.2022 and trial will take time to conclude.

Per contra, learned Public Prosecutor opposed the bail

application.

Looking to the total facts and circumstances of the case but

without expressing any opinion on merits or demerits of the case, I

deem it just and appropriate to grant indulgence of bail to

petitioners under Section 439 Cr.P.C.

Accordingly, the bail applications under Section 439 Cr.P.C. are

allowed and it is ordered that accused-petitioners (1) Kaushal

Kumar S/o Kapil Devi Prasad Yadav (2) Suranjan Kumar

S/o Shivshankar Ram and (3) Pintu Kumar Meena Son Of

Batti Lal Meena, arrested in connection with FIR No.182/2022,

registered at Police Station Gandhi Nagar, District Jaipur City

(East), may be released on bail; provided each of them furnishes a

personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/-

each to the satisfaction of learned trial Court with the stipulation to

appear before that Court on all dates of hearing and as and when

called upon to do so.
