Heard learned counsel for the parties.

Learned counsel appearing for the appellant-claimants as

also learned counsel appearing for respondent-Insurance company

submit that the dispute in between the parties has already been

amicably settled and the parties have entered into a compromise.

It is also submitted that the said compromise has duly been

signed and verified by both the parties before the National

Lokadalat, Rajasthan High Court, Jaipur Bench, which reads as

under:-

“In addition to the award passed by the

M.A.C.T., the appellant shall be paid by the

Insurance Company an additional amount of

Rs.1,50,000/- (In words One Lac Fifty

Thousand Only) including interest. The above

amount shall be paid within a period of two

months from the date of this compromise. In

case payment is not made within two months

from today, it will carry interest @ of 6

percent per annum from subsequent period

i.e. the period subsequent to two months

from today. The costs of the litigation shall

be borne by both the parties. The enhanced

amount be disbursed to the claimant in their

saving bank account.”

In view of submissions advanced by both the counsel for the

parties, and the fact that the compromise has been arrived at in

between the parties, the instant civil misc. appeal is disposed of.

Accordingly, the appeal stands disposed of and the impugned

award passed by the Tribunal stands modified.

Pending applications, if any, also stand disposed of.

Record be sent back.

A copy of the compromise/settlement and the record, if any,

be sent forthwith alongwith this order.
