Instant application has been preferred under Section

438 Cr.P.C. for grant of pre-arrest bail to the petitioner in a

case arising out of F.I.R. bearing No.146/2014, registered at

Police Station, Surajgarh, District Jhunjhunu for commission of

offence punishable under Section 3/7 of the Essential

Commodities Act.

The learned counsel appearing for the petitioner has

submitted that it is alleged that during search, seven cylinders

along with regulators meant for domestic purposes were found in

possession of petitioner, who is engaged in making of “kachori,

samosa etc. Counsel further submitted that the cylinders have

already been recovered by the Investigating Agency.

After hearing the learned counsel appearing for the

petitioner, as well as, the learned Public Prosecutor appearing for

the State, this Court is of the view that in the present case,

custodial interrogation of the petitioner is not warranted.

Consequently, the present application is accepted

and it is ordered that in the event of arrest, the petitioner shall

be released on bail to the satisfaction of the Arresting Officer.

He shall undertake to abide by the conditions specified under

Section 438 (2) Cr.P.C. and shall appear before the Investigating

Officer as and when called for.
