Petitioner has filed this petition under Section 439

Code of Criminal Procedure 1973 seeking regular bail in

F.I.R. No.207/2015 registered at Police Station Hindaun

City District Karauli, for offence under Section 364, 302,

201, 120-B, 379 Indian Penal Code 1860.

Learned cousnel for the petitioner has submitted that

the investigation qua the petitioner was kept pending.

Petitioner is in custody since 26.4.2017. Present case

relates to murder of Bhupesh. Case rests on circumstancial

evidence. The witnesses, who had allegedly last seen the

deceased in the company of the accused have not

supported the prosecution case during trial as challan was

presented against the co-accused of the petitioner. Co-

accused Ramavtar has been granted bail by this court.

Learned State Counsel, on the other hand, has

opposed the petition.

Keeping in view the facts and circumstances of the

present case, it would be just and expedient to order

release of the petitioner on bail.

Accordingly. without expressing any opinion on the

merits of the case, this petition is allowed. Petitioner be

admitted to bail subject to satisfaction of the Trial Court.
