This criminal misc.application for

cancellation of bail has been filed at the

instance of Payal Gupta, the complainant-applicant

for cancellation of bail granted to the mother-in-

law i.e. respondent No.2-Kusum Gupta.

Contention of the learned counsel for

petitioner is that jewellery items, which were

gifted even by the in-laws to the petitioner would

also be part of her stridhan and therefore learned

court of sessions was wholly unjustified in

granting pre-arrest bail to the mother-in-law. It

is contended that though jewellery items given by

the parents of the petitioner to her in dowry were

substantially recovered except two jewellery items

but the jewellery items, which were given in gift

by the in-laws are yet to be recovered therefore
