Matter comes up on a letter received from Justice N.K. Jain,

wherein he has mentioned that he has not accepted any matter

pertaining to arbitration and he is not taking up the matter and

has requested that some other Judge be appointed as an

arbitrator.

I have perused the letter.

Since Mr. Justice N.K. Jain (Retired Chief Justice, Madras

High Court) has shown his inability, hence I deem it proper to

appoint Mr. Justice Guman Singh (Retired Judge) as a sole

arbitrator.

This Court appoints Mr. Justice Guman Singh (Retired Judge),

C-254, Hans Marg Malviya Nagar, Jaipur as an Arbitrator to decide

the dispute.

5.

The appointment of the sole arbitrator is subject to the

declarations being made under Section 12 of the Arbitration &

Conciliation Act, 1996 with respect to independence and

impartiality, and the ability to devote sufficient time to complete

the arbitration within the prescribed period.

6.

The Arbitrator shall be entitled to lay down fees as provided

under Manual of Procedure for Alternative Disputes Resolution,

2009 as amended from time to time.

7.

Registry is directed to intimate Mr. Justice Guman Singh

(Retired Judge) and obtain his formal consent.

8.

Accordingly, letter stands disposed.
