HIGH COURT OF RAJASTHAN - HIGH COURT BENCH AT JAIPUR
ANAND RATHI – Appellant
Versus
STATE OF RAJASTHAN AND ANR – Respondent
1.
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH, JAIPUR
S.B. CRIMINAL MISC. PETITION NO.1517/2014
Anand Rathi vs. State of Rajasthan & Anr.
Date of Order: 03/04/2014
HON'BLE MR. JUSTICE RAGHUVENDRA S. RATHORE
Mr. Keshav Agarwal, for the petitioner.
Ms. Sonia Shandilya, Public Prosecutor.
Mr. R.K. Tongawat, for respondent complainant.
Heard learned counsel for the parties.
This criminal miscellaneous petition has been filed by the
accused petitioner challenging the order dated 05.02.2014, whereby the
compromise entered into between the parties for the offence under
Section 420 and 120 IPC have been attested, but the compromise in
respect of the offence under Section 51/63 of the Copy Right Act has
been declined on the ground that the said offence is not compoundable.
After taking into consideration the facts and circumstances of
the case as well as the fact that the parties have entered into a
compromise and that the complainant, present in person before this
Court, admits with regard to compromise having entered with the
accused petitioner, it is deemed just and proper to allow this criminal
miscellaneous petition
