Order
18/01/2022
Heard.
This contempt petition has been filed alleging willful
disobedience of the order dated 30.01.2019 passed in D.B. Civil
Writ Petition (PIL) No.10819/2018.
Learned counsel for the petitioner would submit that by the
aforesaid order, this Court has directed the PLPC created at the
district level to take action against removal of encroachment. It is
submitted that the present petitioner had also preferred
representation, but action has not been taken.
It appears that in view of the order, referred to above, this
court observed that the number of petitions are being filed
alleging inaction against encroachments. This Court, therefore,
directed constitution of a committee known as Public Land
Protection Cell (PLPC) that such committee shall examine and
verify encroachments.
It appears that the present petitioner has not filed any
petition before this Court, but moved application before the
concerned PLPC.
Therefore, at this stage, we are not inclined to issue any
notice of contempt, but we would direct the concerned PLPC to
examine the complaint of the petitioner and take necessary action,
if any encroachment is found, within a reasonable period and as
far as possible within three months.
Petition stands disposed off.
