Learned counsel for petitioner does

not dispute that impugned order dated

02.03.2012 passed by the District Collector

(Supply), Baran is appealable under clause

(b) of sub-Section (1) of Section 22 of

Rajasthan Foodgrains & Other Essential

Articles (Regulation of Distribution) Order,

1976.

Submission of the learned counsel

for petitioner is that respondents have not

considered their own guidelines and have

passed the order, contrary to the guidelines

issued by the respondents, therefore, this

Court can entertain the writ petition

directly also.

In my view, an alternative remedy by

way of statutory appeal is available to the

petitioner and whatever submissions which

have been advanced in this writ petition, can

be advanced before the Appellate Authority

also.

In these circumstances, I am not

inclined to entertain this writ petition and

the same deserves to be dismissed only on the

ground of availability of alternative remedy.

The writ petition is, accordingly,

dismissed. Stay application is also

dismissed.

It is needless to mention that

petitioner will have a right to file an

appeal, in accordance with law.
