A party is not entitled to an extension of time to vacate a tenanted premises if they have not vacated the premises within the time frame specified in the order of the court and have not provided any details of the search of alternate shop purportedly having been made by them.

Headnote:

Fact of the Case:

The applicants-appellants were granted time till 09.01.2020 to handover the vacant and peaceful possession of the tenanted premises to the respondents. However, the date was wrongly mentioned as 09.01.2020 instead of 09.01.2021. The applicants-appellants filed an application for correction in the order dated 10.07.2019 which was allowed vide order dated 20.08.2019 and in paragraph 1 and 2 of order dated 10.07.2019 the date was substituted as 09.01.2021 in place of 09.01.2020.

Finding of the Court:

The court found that the applicants-appellants had not vacated the tenanted premises even after a year had passed since the order dated 10.07.2019 was passed. The court also found that the applicants-appellants had not provided any details of the search of alternate shop purportedly having been made by them.

Issues: Whether the applicants-appellants were entitled to an extension of time to vacate the tenanted premises.

This application has been filed under Section 151 CPC

seeking extension of time to vacate the tenanted premises.

Learned counsel for the applicants-appellants submits that this

Court vide its order dated 10.07.2019 held the applicants –

appellants entitled to continue in possession of the suit premises till

09.01.2020 subject to the condition that they will handover the

vacant and peaceful possession of the tenanted premises to the

respondents on or before 09.01.2020. He further submits that after

obtaining the certified copy of the order dated 10.07.2019 it came to

notice of the applicants – appellants that date of vacating the

tenanted premises was wrongly mentioned as 09.01.2020 instead of

09.01.2021. Therefore, an application was filed with regard to

correction in the order dated 10.07.2019 which was allowed vide

order dated 20.08.2019 and in paragraph 1 and 2 of order dated

10.07.2019 the date was substituted as 09.01.2021 in place of
