Petitioner in the instant petition has claimed the benefit of

selection grade of the Technical post in the pay scale of Rs. 5500-

9000 with effect from 13th April, 2011 i.e. after completion of 18

years of service.

The petitioner has pleaded that he is working on the post of

Constable (Armor) and this Court in catena of cases has already

directed the respondents to grant such benefit to the employees

who are working on the post of Constable (Armor).

Counsel for the petitioner has cited the order dt. 6th July,

2017, passed by this Court in S.B. Civil Writ Petition No.

10350/2017 (Yaswant Singh Vs. State of Rajasthan and

Ors.). The Co-ordinate Bench at Principal Seat of this Court

further in S.B. Civil Writ Petition No. 12014/2015 (Manak

[CW-12062/2014]

Ram and Ors. Vs. State of Rajasthan), while disposing of the

writ petition by order dt. 24th April, 2017, issued directions that

the persons who are working on the post of Constable/Head

Constable are entitled for the benefit of selection grade in terms of

the judgment passed on 29th August, 1997.

Learned counsel for the respondent does not dispute the

legal position.

The present writ petition is also disposed of with the

direction to the respondents to consider the case of the petitioner

for grant of selection grade of the Technical post in the pay scale

of Rs. 5500-9000 with effect from 13th April, 2011 and necessary

exercise may be undertaken by the respondents within a period of

five weeks after receipt of copy of the detailed representation

along with certified copy of this order.

Accordingly, the present writ petition stands disposed of, as

indicated above.
