By this petition, a direction is sought on the Superintendent of

Police to conduct the investigation in the light of compromise and the

statement of witnesses PW-1 & PW-6.

It is a case where FIR was registered for the offence under

Sections 302, 354 IPC apart from many other provisions. The

investigation was made followed by charge sheet against other

accused. Now the Police is bent upon to take up the case against the

petitioner, though on prior occasions, no role of the petitioners was

found. A compromise has been entered between the parties, thus

aforesaid be taken into consideration by the IO before drawing

conclusions.

Learned Public Prosecutor opposed the petition.

For the offence under Section 302 IPC, a direction for taking

particular view by the IO based on compromise cannot be given. The
