CRLMB/14775/2022
BAIL - POCSO ACT - SECTION 3/4 - STATEMENT OF PROSECUTRIX - ABSENCE OF RAPE ALLEGATION - BAIL GRANTED
Fact of the Case:
The petitioner, a 20-year-old boy, was arrested for allegedly committing rape under Section 376 of the IPC and Section 3/4 of the POCSO Act. The statement of the prosecutrix recorded under Section 164 CrPC did not contain any allegation of rape.
Finding of the Court:
The court found that the statement of the prosecutrix did not contain any allegation of rape, and that the petitioner had no criminal antecedents. The court also considered the petitioner's age and the length of his custody.
Issues: Whether the petitioner should be granted bail in light of the absence of rape allegation in the prosecutrix's statement and the petitioner's lack of criminal antecedents.
Ratio Decidendi: The court held that the absence of rape allegation in the prosecutrix's statement, the petitioner's age, his lack of criminal antecedents, and the length of his custody were all factors that weighed in favor of granting him bail.
Final Decision: The court allowed the bail application and directed that the petitioner be released on bail on furnishing a personal bond of Rs. 1,00,000/- and two sureties of Rs. 50,000/- each.
