On hearing learned counsel for the appellant, learned Public

Prosecutor and taking into consideration the statement of eye

witnesses, namely, Rajenda (PW-1), Sanju (PW-2), Shyani Bai

(PW-3), Ghanshyam (PW-4), Bablu (PW-5) and Rajendra Singh

(PW-15) and Dr. Arun Sharma PW-18 and post-mortem report

Ex.P-26, we are not inclined to suspend the sentence of accused-

appellant. However, the learned counsel for the appellant at this

stage submitted that accused-appellant is in jail for last 7 years

and that he has been engaged by Rajasthan High Court Legal Aid

Committee, and that appellant has no means to prepare the paper

book, Registry may be therefore directed to prepare the paper

book and list this appeal for hearing.

Registry is therefore directed to prepare the paper book,

check the same on priority and thereafter list the appeal for

hearing immediately.

The suspension of sentence application is dismissed.
