The petitioner is seeking anticipatory bail u/Sec.438 Cr.P.C.

in a case arising out of FIR No.248 of 2014 registered at Police

Station Bhiwadi, District Alwar for offence u/Sec.279, 336, 379

& 120-B I.P.C. and Sec.41 & 42 of the Forest Act.

Learned counsel for the petitioner contends that the

petitioner is being involved in the case only because Registration

Certificate of the truck, which has been apprehended carrying

stone, was in his name although he had sold the truck to one

Imran on 03.03.2014 i.e. a month before the FIR was registered.

He further states that Driver of the truck namely Ansar who was

apprehended at the spot has already been released on bail.

Learned counsel for the petitioner has produced before the

court, a copy of the power of attorney dt.03.03.2014 wherein it

is mentioned that the truck has been sold to Imran and

henceforth he shall be responsible for any untoward incident in

connection with the truck. A photo copy of power of attorney

dt.03.03.2014 is taken on record.

Per contra, the learned Public Prosecutor has opposed the

anticipatory bail application.

Without expressing any opinion on the merits of the case, I

deem it to be a fit case to grant anticipatory bail to the

petitioner.

Consequently, the instant bail application u/Sec.438 Cr.P.C.

stands allowed and it is order that in the event of arrest of

petitioner Arshad Khan S/o Shree Sher Mohammad in

connection with FIR No.248/2014 registered at Police Station

Bhiwadi, District Alwar for offence u/Sec.279, 336, 379 & 120-B

I.P.C. and 41 & 42 of the Forest Act, he shall be released on bail

to the satisfaction of the Arresting Officer. The petitioner shall

undertake to abide by the conditions stipulated u/Sec.438(2)

Cr.P.C. and shall appear before the Investigating Officer as &

when called for.
