HIGH COURT OF JUDICATURE FOR RAJASTHAN
MAHENDAR KUMAR GOYAL
OMPRAKASH @ PRAKASH S/O DEVILAL – Appellant
Versus
STATE OF RAJASTHAN – Respondent
CRLMB/15900/2022

In cases involving allegations under the POCSO Act, the court may consider granting bail to the accused if there is a delay in filing the FIR, the prosecutrix is a major, and the accused has no criminal antecedents.

Headnote:

BAIL - POCSO ACT - DELAY IN FILING FIR - MAJOR GIRL - NO CRIMINAL ANTECEDENTS

Fact of the Case:

The petitioner was arrested for allegedly committing rape under the POCSO Act. The FIR was filed by a major girl with a delay of about a month. The charge sheet was filed under Section 376 of IPC, finding the prosecutrix to be major.

Finding of the Court:

The court found that the petitioner had no criminal antecedents and had been in custody since 27.09.2022. The trial of the case would take time.

Issues: Whether the petitioner should be granted bail considering the delay in filing the FIR, the age of the prosecutrix, and the absence of criminal antecedents.

Ratio Decidendi: The court held that it was just and proper to enlarge the petitioner on bail, considering the nature of the allegation, the material contained in the charge sheet, the age of the respective parties, the petitioner's length of custody, and the absence of criminal antecedents.

Final Decision: The court allowed the bail application and directed that the petitioner be released on bail on furnishing a personal bond and two sureties.
