Mr.Shyam Bihari Gautam, for the accused-applicants.

Mr.RR Baisla, Public Prosecutor – for the State.

By the Court:

Heard learned counsel for the accused-applicants as

well as the learned Public Prosecutor and perused the record of

the case.

It is stated that co-accused have been granted bail.

There exists cross cases where from both the sides, one person

has died. The specific allegation does not exists against anyone.

Looking to the aforesaid, accused-applicants may be enlarged on

bail.

Learned Public Prosecutor has opposed this bail

application.

After considering all the facts and circumstances of

the case and without expressing any opinion on merits of the case,

which may otherwise affect outcome of the trial, I am of the view

that accused-applicants deserve to be enlarged on bail.

Accordingly, the bail application under Section 439

Cr.P.C. is allowed. It is ordered that the accused-applicants,

namely, (i) Meera wife of Babulal (ii) Omli wife of Ramkishsor

(iii) Santok wife of Amba Lal (iv) Prem wife of Ganesh (v)

Rameshwar @ Pappu S/o Chaturbhuj (vi) Bajrang Lal S/o

Sukhdev and (vii) Ramkishor S/o Ganesh be released on bail in

FIR No.02/2015 registered at Police Station Baroni, District

Tonk (Raj.) for offence under Sections 302, 307, 323, 147,

148 IPC provided, each of them furnishes a personal bond in the

sum of Rs.50,000/- together with one surety in the like amount to

the satisfaction of the learned trial Court for their appearance

before that Court on all subsequent dates of hearing and as and

when called upon to do so.
