This is a petition under Section 397 read with Section 401 and 482 of Cr.P.C. against the

judgment dated 10.12.2013, passed by learned Addl. Sessions Judge, Court No.5, Agartala

in Criminal Appeal No. 6(1) of 2013 where-under learned Addl. Sessions Judge, upheld the

judgment and order dated 27.11.2012, passed by learned Judicial Magistrate 1st Class,

Court No.4, Agartala, in Case No. Misc. 3206 of 2010 under the Domestic Violence Act.

Heard learned counsel Mr. D. Bhattacharjee for the petitioner and learned counsel Mr. S.

Lodh for the respondent. In view of the earlier order dated 28.4.2014 the matter is taken up

for disposal at the admission stage itself. Learned counsel Mr. Bhattacharjee with all his

fairness has submitted that the petitioner has been living separately from her husband, the

respondent, from the year 2006 but there were communication between them during the

period. The petitioner made application to the Protection Officer in the year 2010 and on

the basis of the report of the Protection Officer, Misc.Case No.3206/2010 was registered
