Heard Mr. T.K. Deb, learned counsel appearing for the applicant.

This is an application under Order 1 Rule 10(2) read with Section

151 of the CPC for additional of The Commissioner of Income Tax (Appellate

Authority), 8Aayakor Bhawan9, M.G. Road, Shilong-793001, Meghalaya, as one

of the respondent i.e. the respondent No.5 in WP(C)No.1027 of 2022.

Mr. T.K. Deb, learned counsel appearing for the petitioner has

submitted that in filing the writ petition, the petitioner has inadvertently not

made party to The Commissioner of Income Tax (Appellate Authority), 8Aayakor

Bhawan9, M.G. Road, Shilong-793001, Meghalaya, as one of the respondent i.e.

the respondent No.5 in WP(C)No.1027 of 2022.

Mr. Deb, learned counsel has further submitted that for proper

adjudication of the writ petition, the said party as referred above is required to

be added as the respondent No.5 to enable the court to effectually and

completely adjudicate upon and to settle all the questions involved in the

instant writ petition being WP(C)No.1027 of 2022.

The addition of party as respondent No.5 reads as under :

Having heard the counsel for the parties, we are of the opinion

that the prayer made by the counsel for the applicant should be granted and

accordingly, it is ordered.
