In this writ petition, the petitioner has

prayed to issue a writ of Certiorari quashing

the

office

order

no.

4156/6-

86/Adhi/Ra.Pa./20-21 dated 28.12.2021 by

which

she

has

been

transferred

from

Dehradun to Uttarkashi.

It is contended before us that this

transfer order is violative of the principles laid

down in the Uttarakhand Annual Transfer for

Public Servants Act, 2017 (Uttarakhand Act

No. 01 of 2018). It is settled principle of law

that the transfer is an incident of service.

Secondly, it is also borne out from the

records that transfer has been made in view

of the ensuing elections of Uttarakhand
