By means of this writ petition, the petitioner has challenged the order dated 20.1.2023 Annexure No.5 to the writ petition and the order dated 03.10.2023 passed by the learned Motor Accident Claims Tribunal/Additional District Judge-II, Kashipur, Udham Singh Nagar in Motor Accident Claim Petition No.46 of 2021 Roop Singh and others vs. Sunil Kumar and others.

4. It transpires that the claim petition was filed by the respondents nos.1 to 4 in respect of the death of son/brother of respondents/claimants, who met tragic death in motor accident on 14.10.2020. Initially claim petition was filed against respondents/defendants Sunil Kumar son of Jaswant Singh registered owner of Tractor No.UK06 Q 2339 and driver of the said tractor- respondent no.7.

During the pendency of the aforesaid claim petition an application under Order 1 Rule 10 of C.P.C. was moved by the registered owner of the tractor saying that the tractor allegedly involved in the accident was sold by him to one M/s Shubham Enterprises through its proprietor Shri Sudhir Rastogi and requested
