Before venturing to answer the legal issues, which has been argued

by the learned Senior Counsel for the parties, certain factual backdrop under

which the case has reached up to this stage is briefly required to be considered.

The petitioner, which is a company registered under the Companies

Act, with an intention for setting up a manufacturing unit for manufacturing

Plastic Bottles, Pet Bottles, P.P. Caps etc. which were consumable goods, had

applied to the Industrial Development Authority, for providing them a land in

order to establish the unit and after the allotment of land having been made in

their favour, the petitioner
