A very peculiar situation which has arisen for

consideration by this Bench is over the controversy in question with

regards to the grant of scale of `3,200-4,900/- to the class IV

employees of the High Court of Uttarakhand, as sanctioned and stood

enforced by the decision of the State Government itself since at the

time of creation of the cadre by virtue of the Government Order issued

by the State. After the approval of his Highness the Governor of the

State on 02.05.2001 the State issued the Government Order being the

Government Order 234/U;k; vuqHkkx 2001. After the grant of the said

scale to class IV employees while sanctioning the cadre strength in
