for the petitioner and Mr. Dharmendra Barthwal, the

learned counsel for the respondent.

In this writ application, the petitioner has prayed

for issuance of writ of certiorari quashing the order

09.06.2016 and 09.09.2016 passed by the learned

Principal Judge, family Court, Dehradun and quashing

the Original Suit No. 215 of 2013.

The issue framed, was heard on 09.06.2016 by

the Principal Judge, Family Court, Dehradun whereby

the learned Judge rejected the objection of the

petitioner by holding that it has a jurisdiction to

decide the matter. It is not disputed in this case that

civil proceedings has been initiated by the petitioner
