Applicant namely Ajay Tyagi, who is in judicial custody,

in connection with F.I.R No. 326 of 2018, relating to offences under

Sections 379, 420, 467, 468, 471, 411 and 120-B of I.P.C and Section

66 of the Information Technology Act, 2000 registered at Police

Station Nehru Colony, District Dehradun has sought his release on

bail.

Learned counsel for the applicant would argue that since,

charge-sheet in the case has not been filed within a period of sixty

days, therefore, the applicant is entitled to default bail under Section

167 (2) (a) sub-clause (ii) of the Code of Criminal Procedure, 1973

(hereinafter referred to as “the Code”).
