JUDGMENT

BARIN GHOSH, C.J. (ORAL)

There is a collaboration agreement followed by a

supplementary agreement. Collaboration agreement has been signed

by the petitioner and respondent nos. 1 to 6. Supplementary

agreement has been signed by the petitioner and by all the

respondents. The collaboration agreement contains an agreement

between the parties pertaining to dispute resolution, where it has been

provided that the parties will try to settle the dispute mutually, failing

which, the same shall be resolved through arbitration to be

adjudicated by arbitrators appointed by both the parties. It was

expressly stated that the arbitration proceedings shall be in accordance

with the Arbitration and Conciliation Act, 1996. The supplementary
