By means of this petition the petitioner seeks

mandamus commanding the respondents to pay the

petitioner his salary @ Rs. 100/- per lecture with

maximum of Rs. 7500/- per month with effect form

October 2003 till he continues to teach after adjusting

the amount already paid to the petitioner.

The petitioner was appointed as part time

Junior Lecturer in the Government Polytechnic, Lohaghat

in November 2002 ans continued till march 2003 on

payment of Rs. 80/- per period with maximum of Rs.

5000/- per month. He was against given appointment in

the same capacity in October 2003 and continuing till

date in the same capacity and is being paid Rs. 65/- per

period with maximum of Rs. 55000/- per month. The only

grievance of the petitioner is that the other person

appointed with the petitioner in the same capacity is

getting Rs. 100/- per lecture or Rs. 7500/- per month

maximum. Hence he is entitled to get the salary at the

same rate.

In view of the facts and circumstances of the

case, it is provided that if similarly situated persons in

the same capacity are being paid Rs. 100/- per lecture or

Rs. 7500/- per month maximum, the petitioner shall also

be paid salary at the same rate.

The petition is disposed of accordingly.
