JUDGMENT

Hon’ble Ravindra Maithani, J.(Oral)

The challenge in this petition is made to the

order dated 22.04.2022, passed in Criminal Revision No.

257 of 2019, Pramod Kumar Vs. Kayyum and others,

passed by the court of 3rd Additional Sessions Judge,

Rudrapur, District Udham Singh Nagar (“the revision”). By

the impugned judgment and order, an application filed by

the private respondent under Section 156 (3) of the Code

of Criminal Procedure, 1973 (“the Code”) has been allowed.

The respondent no. 2 Pramod Kumar Sharma is

Regional Manager in the Syndicate Bank (“the Bank”). He

moved an application under Section 156 (3) of the Code

against the petitioners and another. According to it, a

Kayyum took a loan from the Bank, in which, the

petitioner Fazil Khan stood as Guarantor and mortgaged
