Hon’ble Alok Kumar Verma,J.

The applicant – accused Hitesh Bansal has

invoked the inherent jurisdiction of this Court under

Section 482 of the Code of Criminal Procedure, 1973, to

quash the Complaint Case No.329 of 2018, “Aashish Garg

vs. Hitesh Bansal”, pending before the Additional Chief

Judicial Magistrate, Rishikesh, District Dehradun.

In the said complaint case, filed by the

respondent no.2 – complainant, after enquiry, the

applicant – accused was summoned for the offence under

Sections 420, 468 and 471 of IPC.

Heard Mr. Lalit Sharma, learned counsel for the

applicant – accused, Mr. Lalit Miglani, learned AGA for the

State and Mr. Prabhat Bohra, learned counsel for the

respondent no.2/ complainant.

Aashish

Garg,

complainant, is present before this Court and he is

identified by Mr. Prabhat Bohra, Advocate.

The applicant – Hitesh Bansal is present before

this Court and he is identified by Mr. Lalit Sharma,

Advocate.

respondent

no.2

and

the

applicant

submitted that they have resolved their disputes and after

resolving the disputes, they are living in peace and

harmony. They have filed a Compounding Application (IA

No.01 of 2022) along with affidavits with their free will and

without any pressure.

The respondent no.2 – Aashish Garg further

submitted that he does not want to proceed with the said

complaint case.

The learned counsel appearing for the State has

no objection.

Keeping in view of the totality of the facts and

circumstances of the case, this Court is of the view that

ends of justice would be met, if the Complaint Case

No.329 of 2018, “Aashish Garg vs. Hitesh Bansal”, pending

before the Additional Chief Judicial Magistrate, Rishikesh,

District Dehradun, is quashed.

Resultantly, the Complaint Case No.329 of 2018,

“Aashish Garg vs. Hitesh Bansal”, pending before the

Additional Chief Judicial Magistrate, Rishikesh, District

Dehradun, is quashed.

11.

The Criminal Miscellaneous Application No.720

of 2022, filed under Section 482 of the Code of Criminal

Procedure, is disposed of accordingly.
