The present C482 application is filed

seeking to quash the order dated 29.09.2015

passed by the J.M. First Class, New Tehri in

Misc. Crl. Case No.64 of 2015, Smt. Gangesh

Sharma v. Ramesh Panwar as well as the order

dated 13.09.2017 passed by the CJM, Tehri

Garhwal in Criminal Complaint Case No.310 of

2015, State v. Ramesh Panwar and others.

In brief, facts of the case are that the

applicant Ramesh Panwar filed a complaint u/s

138 of the N.I. Act against the respondent no.2-

Gangesh Sharma before the Court of J.M. First

Class, Tehri Garhwal in the year 2013 which

was registered as Criminal Case No.176 of

2013, Ramesh Panwar. Gangesh Sharma; after

hearing both the parties, the Trial Court passed

the judgment on 01.11.2014; aggrieved thereby,

the respondent no.2 preferred CRLA No.30 of

2014 before
