WPMS No.1347 of 2021

Hon ’ble Sh ar ad Ku m ar Sh ar m a, J.

(Via video conferencing).

Mr. Ashutosh Thakral, Advocate, for the

petitioner.

The petitioner has preferred this writ

petition seeking an appropriate direction to the

District

Consumer

Dispute

Redressal

Commission, to decide his Complaint Case

No.513 of 2015, “Shri Bechan Lal Sharma Vs.

Principal, Adarsh Bal Niketan”, which is

pending consideration before the respondent

No.1.

The argument of the learned counsel for

the petitioner is that this Court while exercising

its supervisory jurisdiction under Article 227 of

the Constitution of India, can very well issue

directions to the District Consumer Dispute

Redressal Commission, for deciding the lis

which is pending before it for the reason that it

falls to be within the definition of the

subordinate court to the High Courts, in light of

the judgment laid down by the Hon’ble

Allahabad High Court, in a Division Bench

judgment reported in 2012, (95) ALR, page
