Ms. Shivangi Gangwar, Advocate present for

the petitioner.

Mr. Bharat Tewari, Advocate present for the

respondents no.1 & 2.

By means of present writ petition, the petitioner

seeks to issue a writ or direction to the Civil Judge

(J.D.), Haldwani, District Nainital to decide the

temporary injunction application filed in Civil Suit

no.63/2014 as expeditiously as possible, preferably

within a period of one month.

Whereas learned counsel for the petitioner has

pressed the first part of the prayer made in the writ

petition, she has not pressed the second part of the

relief sought for, which seeks to issue direction to the

court below to decide the civil suit no.63/2014 as

expeditiously as possible.

It is the submission of learned counsel for the

petitioner that respondents no.1 & 2 filed an original

suit against the petitioner for restraining him from

interfering in the possession of disputed land.

Injunction order was granted in favour of the plaintiff.

Thereafter,

the

petitioner/defendant

moved

an

application for vacating the interim stay alongwith

objections, which are still pending adjudication before
