JUDGMENT

Hon’ble Ravindra Maithani, J. (Oral)

The instant revision is preferred against the

following:-

(A) judgment and order dated 31.10.2018,

passed in Criminal Case No.207 of 2017, State Vs.

Somnath, by the court of 1st Additional Civil Judge

(Junior Division)/ Judicial Magistrate, Roorkee, District

Haridwar (“the case”). By it, the revisionist has been

convicted under Sections 279, 337, 338, 427 & 304-A

IPC and sentenced as hereunder:-

(i)

Under Section 279 IPC, 6 months rigorous

imprisonment and a fine of Rs. 200/-. In

default

of

payment

of

fine,

rigorous

imprisonment for a further period of 10

days.

(ii)

Under Section 337 IPC, 6 months rigorous

imprisonment and a fine of Rs. 200. In

default

of

payment

of

fine,

rigorous

imprisonment for a further period of 10

days.

Under Section 338 IPC, 2 years rigorous
