This appeal is preferred against the
order dated 14.09.2015 passed by the learned
District Judge, Dehradun, in Misc. Case No.
110 of 2015, whereby learned District Judge,
refused to grant ex‐parte injunction and further
issued notice to the defendants on the
application moved by the applicant under
Section 9 of the Act.
It is contended by learned counsel for the
appellants that 21.09.2015 is the date fixed in
the matter and, in case interim order is not
granted, the respondents will enchash the Bank
Guarantee, and the petition of the petitioner
before the trial court as well as appeal filed
before this court, will render infructuous.
In my view, no useful purpose would be
served by keeping the appeal pending.
Considering the facts and circumstances
that has been brought on record, I dispose of
the appeal with the
