no counter affidavit on behalf of the respondent State is

found to be required in the present case.

482 Cr.P.C., the applicant seeks to quash and set aside the

charge sheet dated 21.12.2006; cognizance / summoning

order dated 02.01.2017, passed by Addl. Sessions Judge /

Special Judge POCSO, Rudrapur, District Udham Singh

Nagar, in Sessions Trial no. 01 of 2017 (FIR no. 290 of

2016) for the offences punishable under Sections 376D,

506 IPC and Section ¾ of Protection of Children from

Sexual Offences Act, 2012, registered at police station

Sitarganj, District Udham Singh Nagar.
