Heard Sri Ramesh Kumar Shukla, learned counsel for the appellant, Sri

Ankit Srivastava, learned A.G.A. for the State.

An application dated 9.05.2022 supported by an Affidavit has been filed

by the appellant claiming himself to be juvenile at the time of occurrence.

The counter-affidavit to the same has been filed by the State to which a

Rejoinder-Affidavit has been filed.

The appellant claims his date of birth to be 1.1.1969 as per the photocopy

of the pariwar register, driving license, pan-card and Adhar Card which is

annexed as Annexure 1 to the affidavit in support of his application.

The State itself in counter-affidavit in paragraph 5, while relying upon the

Pariwar Register, a copy of which has been annexed as Annexure C.A.1 to

the same, states that as per the said Pariwar Register, the year of birth of

the appellant is 1969. The claim of the juvenility has been raised before

the court after conviction of the appellant
