List has been revised. No one has appeared on behalf of the

appellants to press this criminal appeal, however, learned AGA

for the State is present.

Chief Judicial Magistrate, Pilibhit, vide his letter dated

09.04.2021, has informed this Court that all the appellants, who

are father and sons, have already expired. Appellant No. 1 Bhim

Sen died about 10 years back. The appellant No. 2 Vidya Ram

died on 08.1.2016 and appellant no. 3 Komil Prasad died about

21 years back. In verification of their death, statement of Prem

Pal, son of Vidya Ram, Mithai Lal, nephew of deceased Bhim

Sen has been recorded. Statement of Gram Pradhan, Lalita,

Village Makrandpur, Police Station Jahanabad, District Pilibhit

has also been recorded. Police report of Sri Upendra, S.I. Police

Station Jahanabad, District Pilibhit has also been annexed.

In view of the above, since all the appellants, Bhim Sen, Vidya

Ram and Komil Prasad had already expired, this criminal

appeal is dismissed as having been abated.
