Heard Sri Ashutosh Kumar Singh, learned counsel for the petitioner; learned

Standing Counsel for the respondent nos. 1 and 3 and Sri Arif Ikbal, learned

counsel for the respondent no.2-Bank.

This writ petition has been filed praying, inter alia, for the following reliefs:

"1. Issue a writ, order or direction in the nature of certiorari quashing the impugned recovery

certificate/citation issued by the respondent no.3 against the petitioner.

2. Issue a writ, order or direction in the nature of mandamus directing the respondents not to

take any coercive measure against the petitioner for recovery of the amount mentioned in the

impugned recovery certificate/citation dated 1.12.2021 issued by the respondent no.3".

Sri Arif Ikbal, learned counsel for the respondent-Bank states on instructions

that if the petitioner deposits Rs. 4,35,000/ by 31.3.2022, then the loan account

of the petitioner shall stand regularized and the impugned recovery certificate

shall not be pressed.

Learned counsel for the petitioner states that the petitioner is ready and shall

deposit the amount of Rs. 4,35,000/ as stated by the learned counsel for the

respondent-Bank by 31.3.2022.

In view of the aforesaid and as agreed by the learned counsel for the parties

before us, this writ petition is disposed of giving liberty to the petitioner to

approach the respondent-Bank within a month alongwith a copy of this order

and deposit a sum of Rs. 4,35,000/ before 31.3.2022. Thereafter, the respondent-

Bank shall comply with the statement given through the counsel as aforestated.

For a period of six weeks from today, no coercive action shall be taken against

the petitioner pursuant to impugned recovery certificate.

The writ petition stands disposed of.
