This is an appeal of the year 1996.

Learned counsel for the appellant Sri V.C. Katiyar is

reported to be dead.

Office report dated 20.9.1996 indicates that lower court

record has been received. Office report dated 27.10.2021

indicates that pursuant to the order dated 3.3.2021 passed

in Criminal Appeal NO. 5361 of 2003 a letter was sent to

the Chief Judicial Magistrate to furnish the living status of

the appellant. The Chief Judicial Magistrate in his letter

dated 23.4.2021 has informed that the appellant-Randheer

Singh named does not live in the village and could not be

verified that the appellant is dead or alive.

As on date it can be presumed that the appellant is

missing.

Let non-bailable warrant be issued to the appellant-

Randheer Singh and the Chief Judicial Magistrate is

directed to get the non-bailable warrant executed and

ensure the arrest of the appellant-accused Randheer Singh
