Heard the learned counsel for the parties.
The present petition under Article 226 of the Constitution of India
has been filed challenging the order dated 28.07.2006 passed by
the Additional Commissioner (Judicial), Lucknow Division, Lucknow
in Appeal No.988 of 1999-2000 as well as against the judgment and
order dated 30.09.2021 passed by the Board of Revenue,
Allahabad (U.P.) in Revision No.87 of 2005-06/Hardoi, filed against
the order of the Additional Commissioner.
Through his order dated 28.07.2006, the Additional Commissioner
has allowed the substitution application filed by the opposite parties
for substituting the heirs of one of the deceased-respondent in
Appeal No.988 of 1999-2000 after setting aside the abatement of
the said appeal. The revision filed against the order of Additional
Commissioner has been rejected by the Board of Revenue.
There is no illegality in orders passed by the revenue courts and
the orders are interlocutory in nature, which do not finally decide
the rights of the parties.
In view of the aforesaid, it is not a fit case for interference under
Article 226 of the Constitution of India.
The writ petition is, accordingly, dismissed.
