Heard learned counsel for the applicant, learned A.G.A for the State and

perused the record.

It is submitted by learned counsel for the applicant that the applicant is

innocent and has been falsely implicated in the present case. He has not

committed the present offence. No prima facie case is made out against the

applicant. Victim was major and a consenting party. F.I.R. was lodged by

the victim herself due to pressure created by the family members.

Referring to contents of affidavit, it is further submitted that statement

under Section 164 CrPC was also given by the victim on the basis of

pressure and advise. Neither any symptom of rape nor any sign of protest

was found. The applicant has no criminal history. He is languishing in jail

since 11.11.2020 and in case he is released on bail, he will not misuse the

liberty of bail
